1. registration
Registration can be made in writing (by mail, e-mail) or by telephone. It is binding. With the written confirmation of us as the organizer, a binding participant contract between the participant and the organizer. If one person registers more than one participant at the same time, the person who registers is liable for the payment of the invoice amount.
2. payment
The booking becomes binding for you and us with the written confirmation of your registration by us. A deposit of 20% of the invoice amount is due on the invoice sent to you at the same time as the confirmation of registration. The remaining amount is due as agreed in the individual case. If there is no agreement, the remaining amount is due no later than 14 days before the start of the event. In case of noncompliance with the payment due dates, we are entitled to withdraw from the contract after issuing a reminder with a deadline and to charge you with withdrawal costs.
3. costs
The prices include only the indicated services and are per person.
4. minimum number of participants
Guided tours can in principle only be carried out if the specified minimum number of participants is reached. If this is not reached, we are entitled to withdraw up to 14 days before the start of the event. The amount already paid will be refunded in full. Should you nevertheless insist on the event taking place, a new contract with recalculated prices will be concluded. If you agree with the new contract, the event can be carried out on its basis. However, we will endeavor to carry out the planned event even if the minimum number of participants is not reached, as long as it is economically justifiable for us.
5. change in the person of participant
If, for whatever reason, you are unable to make the event, you can transfer the contractual relationship to another person. However, the person to whom the contractual relationship is transferred must meet all the conditions for participation and the transfer must be communicated to us within a reasonable period before the start of the event. However, a refusal of the transfer by us is possible in any case.
6. withdrawal by the participant
You can withdraw from the event at any time before the event begins. This should be done in writing due to the preservation of evidence. Depending on the time of withdrawal, the following cancellation fees will apply:
Cancellation up to the 31st day before the start of the event will only incur a processing fee of 55,- Euro per person.
30th–21st day before the start of the event: 10%
20-15 days before the event: 50%
14-01 days before the event: 100%
on the day of the event start or in case of no-show: 100%
If a participant leaves the group prematurely, for whatever reason, he/she is not entitled to a refund.
Furthermore, the cancellation costs of the accommodations reserved for you by the organizer are to be paid.
7. withdrawal by the organizer
If, despite a warning from the organizer/tour guide, you persistently disrupt the event, fail to meet the requirements stated in the invitation to tender and thereby jeopardize the planned execution of the event, or behave in a manner contrary to the terms of the contract to such an extent, we may withdraw from the contract. In this case, the costs will not be refunded. If a cancellation on our part occurs due to force majeure, i.e. due to unusual and unforeseeable events over which we had no control and the consequences of which could not have been avoided despite exercising due care, we as organizer may also cancel the event without being exposed to any claims for damages. Such events include, for example, unfavorable conditions, government orders, strikes, war or war-like conditions, natural disasters, epidemics, pandemics, etc. In such an event, expenses will be reimbursed less our administrative expenses.
8. services not used
If individual services that were properly offered are not used for reasons that are attributable to you (e.g. due to early return), there is no entitlement to a pro-rata refund of costs. All events are conscientiously prepared by us. However, we cannot guarantee summit or subjectively imagined success for the completion of the planned event.
By registering, you acknowledge the risks of the mountains (e.g. danger of falling, falling rocks and ice, avalanches, crevasse fall, altitude sickness, cold damage, etc.), which cannot be completely reduced and excluded even by careful and caring supervision by a tour guide.
It should also be noted that in the mountains, especially in remote regions, due to technical or logistical difficulties, rescue or medical treatment options may be very limited, so that even minor injuries and incidents can have serious consequences. In this case, each participant is required to exercise a considerable degree of personal responsibility and prudence, to prepare his or her own tour appropriately and to make a realistic self-assessment with regard to the participant requirements listed in the event, which are an integral part of the contract.
9. requirements
You must meet the requirements stated in the event (e.g. fitness, health, etc.). If these are not met, we are entitled to exclude you from the event in whole or in part. In this case, you are not entitled to a refund. You are obliged to follow the instructions of the tour guide. If the instructions are disregarded or if safety is endangered by your behavior, the tour guide can exclude you from further participation. In this case the costs will not be refunded. Any additional costs will be charged to the participant. The tour guide reserves the right to refuse to guide any person who is poorly equipped, or whose state of health or fitness required for the planned event is questionable.
10. insurance
An appropriate insurance is the responsibility of the participants. We recommend that you take out accident and health insurance (including high altitude risk, rescue and recovery costs), as well as travel cancellation insurance. A membership in the Alpine Club or a membership in the Friends of Nature usually includes rescue costs in the alpine region.
11. liability
The tour guide cannot guarantee absolute safety from the objective dangers in the mountains. The participant accepts the natural residual risk (such as danger of falling, altitude sickness, cold, avalanche danger, crevasse fall, rock fall) of mountain hiking, which remains despite careful and prudent guidance. By booking, these dangers are acknowledged and the participant waives any claim for damages and similar claims against the organizer and the tour guide. We as the organizer are not liable for any disadvantages and damages of any kind, if they were caused without the fault of the organizer or a professional staff of the organizer. The organizer and the tour guide are not liable for arbitrary actions of the participants and non-compliance with the instructions!
12. place of jurisdiction and applicable law
The place of jurisdiction is Bruck an der Mur or Liezen. Austrian law is agreed, so that the contract is subject to Austrian law by choice of law.
13. difficulty rating
We try to rate our events as good as possible. Nevertheless, due to weather conditions and the condition of the day, a mountain tour can seem easier or harder. In addition, the usual ascent times or the difference in altitude under normal conditions are given for each mountain tour. Nevertheless, we appeal again to assess your condition objectively and not to book a mountain tour at your personal limit, as the fun will certainly be limited and there will be no room for maneuver. Your individual preparation is the be-all and end-all of every mountain tour, therefore accustom your body slowly to the upcoming tour. Train enough endurance combined with altitude adaptation and nothing will stand in the way of your dream tour.
14. general information
weather
Hiking is a sport that is decisively influenced by the weather (rain, snowfall and storms). The planning of our events is based on the available weather reports. However, experience shows that weather forecasts for mountain regions are not always accurate. Forecasts are often only possible with severe limitations. As mountain sports enthusiasts, we must also be aware of rain, snowfall and storms. Those who are not prepared to accept the weather risk and all its effects on the advertised program will probably not enjoy the mountains in the long run.
14.2 Basic information about recreational sports in the mountains:
We plan our events to the best of our knowledge and belief. However, due to the mountain environment, there is always a residual risk, the dangers, imponderables and accident risks of which sometimes cannot be influenced. The organizer/tour guide strives for the greatest possible safety with the best possible execution of the event. However, a certain degree of personal responsibility and prudence on the part of the participant is essential. Due to the described problems in the mountains, the organizer and the local guide reserve the right to adapt the planned program to existing conditions. In order to guarantee the best possible know-how, all events will be carried out exclusively by state-certified mountain hiking guides and/or mountain and ski guides.
14.3 photo- und film material
Photos and film material taken during the event may be used by the organizer for advertising purposes.
